Welcome to Foodino. By accessing or using the Foodino application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.
1. Use of the App
Foodino provides tools to help households manage groceries, reduce food waste, and collaborate on shopping and meal planning. You may use the App for personal, non-commercial purposes only.
You agree not to:
- Use the App for any unlawful or fraudulent purpose
- Attempt to reverse-engineer, copy, or modify the App
- Interfere with or disrupt the App's functionality or servers
- Impersonate another person or misrepresent your identity
- Upload harmful, offensive, or inappropriate content
2. Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You are also responsible for managing any purchases, renewals, or cancellations made through your Apple App Store or Google Play account in connection with the App.
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.
3. Intellectual Property
All content, features, branding, and functionality of the App including but not limited to text, graphics, logos, the Foodino mascot, and software are owned by Foodino and protected by applicable intellectual property laws.
You may not reproduce, distribute, or create derivative works from any part of the App without our prior written consent.
4. User Content
You retain ownership of any content you create within the App (such as shopping lists or household items). By using the App, you grant Foodino a limited license to process this content solely to provide and improve the service.
5. Premium Subscriptions and Billing
Some features of the App may require a paid subscription or other in-app purchase ("Premium Subscription"). The features, price, billing period, and any trial terms will be shown in the App or in the applicable app store before you complete the purchase.
Premium Subscriptions purchased through the Apple App Store or Google Play are billed by that platform and are also subject to its terms, payment rules, and refund policies.
If you purchased a Premium Subscription through the Apple App Store, refund requests must be submitted to Apple and will be handled under Apple's applicable policies.
If you purchased a Premium Subscription through Google Play, refunds are subject to Google Play's rules and applicable law. Where permitted, we may also assist with purchase issues or process refunds directly.
Unless otherwise stated at the time of purchase, Premium Subscriptions renew automatically at the end of each billing cycle until canceled. You can manage or cancel your subscription through your Apple or Google account settings. Cancellation generally takes effect at the end of the current paid period.
Except where required by law or the relevant app store rules, subscription fees are non-refundable once charged. We may change subscription pricing, benefits, or availability prospectively, with notice where required.
Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
6. Advertisements
The App may display third-party advertisements, including ads served by Google AdMob, particularly in free or ad-supported experiences. We are not responsible for the content, offers, products, services, or privacy practices of third-party advertisers or linked websites.
If a Premium Subscription is described as reducing or removing ads, that benefit applies only to the scope expressly stated in the purchase flow and may exclude certain branded content, cross-promotions, transactional messages, or legally required notices.
7. AI-Powered Features
The App includes AI-powered features such as recipe suggestions, receipt scanning, and the Dino voice assistant. These features are provided on an "as is" basis. While we strive for accuracy, AI-generated suggestions (including recipes and nutritional information) should not be considered professional dietary, medical, or nutritional advice.
8. Availability and Updates
We aim to keep the App available at all times, but we do not guarantee uninterrupted or error-free access. We may update, modify, or discontinue features at any time without prior notice.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, secure, timely, or error-free, or that defects will be corrected.
10. Limitation of Liability
To the fullest extent permitted by law, Foodino and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
This includes any loss of data, profits, revenue, business opportunities, or goodwill, and any damages resulting from your use of or inability to use the App.
11. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the App ceases immediately.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws where Foodino operates, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be reflected with a new "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.
